In March, 2019, our office filed suit and settled it within 7 months. The Plaintiff was traveling on Sanford Road in Westport, MA when his motor vehicle was struck broadside by a motor vehicle that had proceeded through the stop sign at the intersection and entered Sanford Road from Briggs Road. The Plaintiff sustained a strain to his lower back as well as his left wrist, shoulder and elbow.
This case was referred to Brian Cunha & Associates by an attorneys’ office in Fall River in October, 2019 and was settled by the end of the year. Case stems from a slip and fall incident which occurred in May, 2017 at a nursing home in Somerset, Massachusetts. The Plaintiff injured his ankle and required a surgery to repair same.
On November 1, 2019, Samantha was riding as a passenger in a vehicle that was traveling east on Route 6 in Seekonk, MA when a vehicle traveling south on Route 136 entered the intersection and the 2 vehicles collided . A wind storm had knocked the power out and therefore traffic lights were not operational in the area at the time of the collision. Our office filed suit and the case settled by the end of the year. The Plaintiff was a bicyclist riding on the bike path in Barrington, RI in August, 2017 when he was struck by a motor vehicle as he was crossing Sowams Road. The Plaintiff sustained injuries to his wrist and hip for which he underwent surgery. In November, 2017, Laura was a bicyclist traveling South on Head of the Bay Road in Bourne, Massachusetts. A motor vehicle, also traveling South on Head of the Bay Road, struck the plaintiff from behind, causing her to become airborne and fall to the ground approximately fifteen (15) feet into the wooded area, wherein she sustained injury to her chest, abdominal, pelvic and low back pain and tenderness. She further experienced increased anxiety and Post-traumatic stress due to the collision.
The Plaintiff was a motorcyclist traveling straight on Fish Road in Tiverton, RI when a motor vehicle proceeded through the stop sign on Hooper Street in front of the motorcycle, causing a collision. In addition to the “road rash” on the plaintiff legs, he also sustained injuries to his head, neck and left knee. The Plaintiff retained the Law Offices of Brian Cunha & Associates and settled the case for a favorable amount.
In May, 2014, Margaret was in the produce section of a grocery store in Fall River, Massachusetts when she was caused to slip and fall on grape(s) that were on the floor. Margaret was wearing flip flops and the grape was stuck to the bottom of her flip flop. At the time of this incident, the Plaintiff was healing from an unrelated surgical procedure two months prior. Her fall in the grocery store resulted in the opening of the prior surgical wound that required surgical interventions to repair. The insurance company vigorously defended the case claiming no liability and that her injury pre-existed the fall.
The Plaintiff retained The Law firm of Brian Cunha and Associates after a prior law firm was unable to resolve her case. In April, 2018 a her case was successfully settled at Mediation within one year of our firm having the file.
February, 2019, the Plaintiff was operating his motor vehicle upon Old Faunce Corner Road in Dartmouth, Ma, when a vehicle failed to stop at the red light, striking the front end Freddy’s vehicle, causing the airbags to deploy and the vehicle to spin completely around before it came to rest in the grassy ditch several yards from the collision site. The collision was of such velocity that Mr. Perez’s vehicle was deemed a total loss. Freddy sustained: cervical, thoracic and lumbar strains as well as a comminuted, displaced left clavicle fracture. The Defendant only had $20,000.00 on his automobile policy, however Attorney Nelia De Stefano, from the Law Offices of Brioan Cunha & Associates was able to obtain an additional 60,000.00 from the underinsured provision in the Plaintiffs own policy. In Mid-December, 2017, the Plaintiff was the seat-belted operator of his motor vehicle and traveling on County Road in Barrington Rhode Island, when another vehicle attempting to exit a parking lot to take a right hand turn Southbound onto County Road collided with his vehicle. The impact was such that Vincent’s vehicle skidded, spun completely around, went over the curb, struck and drove through a bus shelter structure before finally coming to rest against a wooden utility pole, causing it to crack. Vincent suffered with daily headaches, forgetfulness, interrupted sleep and neck pain radiating down to bilateral upper extremities. He was diagnosed with a pinched nerve, cervical neuropathy and post-concussion syndrome. In late June 2018, the Plaintiff was involved in a motor vehicle collision wherein her vehicle was struck on the drivers’ side at an intersection in Fall River, MA. She was extricated from her vehicle and transported to St. Anne’s Hospital where she was diagnosed with multiple rib fractures and a presumed aortic injury based on initial CT scan and mechanism of injury. She was transferred to R.I. Hospital for further management of aortic injury that was ultimately an incidental finding of a heart issue that was unrelated to the collision.
